1. GENERAL INFORMATION
After the Consumer approves the Distance Sales Agreement, if the Ad Owner, who is the provider of the relevant service, also approves the Distance Sales Agreement, this Distance Sales Agreement will be established between the parties (between the Ad Owner and the consumer), approves of this situation.

The Ad Owner may request the Guest to sign his own rental contract for any reason, including but not limited to, as required by the insurance companies or as per the company policy. The Guest is obliged to sign the contract communicated to him by the Ad Owner.

4. BASIC FEATURES AND PRICE OF THE CONTRACTUAL GOODS AND SERVICES

It may be the case that various additional costs cannot be determined on the date of this Preliminary Information Form or on the date of the distance sales contract (especially extra services that are not required to be purchased). In case the consumer requests additional services during the Equipment rental service and/or Teknevia Extra and the provision of the Services, the cost of these will be charged separately.
The Owner of the Advertisement is responsible for the accuracy of the information contained in the advertisement subject to the reservation. If there is a disagreement between the Guest and the Ad Owner regarding the details of the advertisement and/or reservation, the Guest and/or the Ad Owner are responsible for proving their own claims.
The commitment made by the Ad Owner regarding Equipment and Services to a Guest who has made a reservation is limited to the Basic Advertisement Details. In this context, “Basic Reservation Details” in any case, before and after the reservation request, the completion of the reservation and the payment, are included in this Preliminary Information Form and/or the Distance Sales Contract accepted by the Ad Owner and/or the Guest. Equipment, Extras and Services cover all reservation-related information. Any extra requests not included in this information incur extra charges.
Method of calculation of prices that cannot be calculated in advance: In case the consumer requests additional services during the Equipment rental service and/or Teknevia Esktra and the provision of the Services, and/or purchases extra services that are not mandatory, their fee will be calculated in accordance with the information communicated to him at the time of the request, and also will be requested from the consumer.
5. TERMS OF PAYMENT AND DELIVERY, INFORMATION ON PERFORMANCE

In cases where a Transitlog Document is required to be obtained from voyages that are not considered as Administrative Port Expeditions, this fee is paid by the consumer to the boat owner. Otherwise, there is no transitlog fee.
If it is stated in the Ad that the captain and crew are included, it is included in the price per Reservation.
A Final Cleaning fee may be required for reservations for Boats with a length of more than 16 m and with more than 12 customers participating in Charters without a Captain or Crew. Otherwise, the final cleaning fee is included in the price.
All fees and expenses that are not expressly included in the Reservation Fee are excluded from the Reservation Fee.
Remaining Payment must be made on the Entry Date. Otherwise, “5.2.d. The rules described under the “Cancellation and Change Conditions” will be applied.
Fees for additional services that are mandatory and non-obligatory to be purchased will be paid directly to the Ad Owner when the Equipment is received by the Guest.

For overnight rentals, the Announcer may (without limitation) request the Equipment to return to and stay connected to its last evening departure location for reasons such as refueling and/or completion of checkout procedures. At the check-out location, the Guest may stay at the Equipment until the check-out time the next day (ie the day of departure).
LEGAL NATURE OF THE PREPAID:
The Advance Payment is in the nature of a deposit and in the cases explained under the "Cancellation and Change Conditions" below, the said deposit may not be refunded to the Guest.
The Advance Payment (and the Remaining Payment at the provider's preferences) is collected by Teknevia (or Teknevia's Distribution Partners, defined below) on behalf of the Ad Owner who is the provider. The said payment is deemed to have been made by the Guest, who is a consumer, to the Ad Owner. The Announcement Owner has accepted in advance to appoint Teknevia and (Teknevia's Distribution Partners) as the authorized representative acting by proxy, regarding the collection transactions related to the services subject to this Preliminary Information Form and only limited to these transactions. Any action to be taken by Teknevia and/or Teknevia's authorized persons and/or Teknevia's Distribution Partners shall be deemed to have been made by the Announcer on his behalf.
Announcement Owner and Guest declare that they have authorized Teknevia and Teknevia's Distribution Partners to manage the collection process in the aforesaid manner and that the Guest fulfills its payment obligation by paying the relevant reservation fee to Teknevia (and/or Teknevia's Distribution Partners). They have declared and accepted that they have done so and that they are not obliged to pay the Ad Owner again, except for the costs of extra services.
Teknevia shall forward the Advance Payment and any other amount to be paid by the Guest to the Announcer regarding the service to be provided by the Ad Owner within the framework of this Preliminary Information Form and the Distance Sales Agreement. However, within the framework of the independent relationship between Teknevia and the Announcer, Teknevia may clear and/or set off any receivables that have arisen or will arise against the Announcer from the amounts it will transmit to the Announcer. The said clearing and/or set-off shall not be interpreted as keeping any amount belonging to the Guest at Teknevia.
TERMS OF CANCELLATION AND CHANGE:
Prepayment is paid by the Guest at the time of booking. After the booking confirmation by the Ad Owner, the reservation can be canceled free of charge for 3 (three) days (ie, within the "Free Cancellation Period") (free of charge until the Timeout Date if less than 3 (three) days are left before the Timeout Date described below. can be cancelled). For cancellations made after the said Free Cancellation Period has expired, the Advance Payment is non-refundable. The Remaining Payment must be made by the Timeout Date, unless otherwise specified by Teknevia. In any event, the reservation becomes final as of the Timeout Date (explained below); no refund in case of cancellation; If there is an ongoing free cancellation right, this right is terminated.
BOOKING TYPE SELECTED BY THE GUEST:
The reservation of each advertisement published on the site (on teknevia.com and related mobile applications and social media accounts, briefly referred to as the "Site") may be subject to only one of the following cancellation and change options:
Flexible Reservation: The Timeout Date is 3 (three) days before the Check-in Date.
Semi-Flexible Reservation: The Timeout Date is 7 (seven) days before the Check-in Date.
Strict Reservation: The Timeout Date is 10 (ten) days before the Entry Date.
Super Solid Reservation: The Timeout Date is 30 (thirty) days before the Check-in Date.
Within the framework of this Preliminary Information Form, “Timeout Date” refers to the date on which the reservation is finalized. In cancellations made by the Guest after this date, the payments collected by Teknevia will not be refunded to the Guest. The Timeout Date will be determined according to the cancellation and change options described above.
If the Guest is not present at the place where the Equipment will be delivered or the Teknevia Services will be provided on the Check-in Date (i.e. the date on which the relevant Equipment rental or the provision of Teknevia Services begins) without canceling the reservation, Teknevia will not refund the Guest any money made. payments are deemed to have been collected as cancellation fees.
If the Guest does not receive the Equipment subject to the reservation or Teknevia Services without canceling the reservation on the Site or notifying Teknevia via e-mail by the same date of the cancellation of the reservation by the Timeout Date (even if the remaining Payment is due on the Entry Date) even) The Guest will be responsible for the entire Reservation Fee. In this case, the Ad Owner may request the Remaining Payment.
In distance contracts, in cases where the payment is made with a credit card, debit card or similar payment card without issuing a spending document, in case the card is used unlawfully by someone else; Transactions are made in accordance with the provisions of the Bank Cards and Credit Cards Law No. 5464 dated 23/2/2006 and the Regulation on Bank Cards and Credit Cards published in the Official Gazette dated 10/03/2007 and numbered 26458.
POLICIES TO BE APPLIED IN CASE OF FORCE MAJEURE
Regarding general restrictions and developments, such as curfews and travel bans, that prevent any Guests from receiving any Equipment (or if the subject of the reservation is a Teknevia Services and not located at the location where the relevant Teknevia Services will be offered), the Ad Owner will comply with the following standard It chooses one of the 3 policies and applies the policy it has chosen in case of such a situation. The Owner of the Advertisement (i) refunds the entire fee without any deduction, (ii) postpones the reservation to a later date in line with the Guest's choice***, (iii) refunds the fee or changes the date without any deduction upon the request of the Guest. *** does. If the subject of the reservation is the rental of an Equipment, or an Extra is offered with the rental of an Equipment, and such force majeure is a situation that can be prevented by selecting another Equipment, such as a failure of the Equipment, Teknevia will, at its sole discretion, as a guest, it can assist the Guest in finding a new Equipment. If an alternative Equipment is available, and the Guest agrees to have this Equipment delivered to them instead of the original Equipment, a new (second) reservation will be created in this regard, the payments for the first reservation will be exchanged and/or deducted from the reservation price of the second reservation. However, if Teknevia wishes, it may request from the Announcer that the payments made in connection with the canceled reservation be paid to the Guest immediately and in cash.
The "date change" / "date postponement" mentioned above will be made as follows: One of the available dates within the following 2 seasons, proposed by the Ad Owner to the Guest, will be selected by the Guest. The Ad Owner will suggest at least 6 different dates to the Guest. When determining the proposed dates, the Ad Owner will also consider the months in which the Equipment or Services should be rented/offered in accordance with the initial reservation (“Booking Months”). In this context, at least 2 of the dates suggested by the Ad Owner will be included in the Booking Months within the 2 following seasons (for example, if the booking was originally made for July, 2 of the suggested dates will be in/in July of the 2 following seasons. will take). If the Ad Owner does not propose an alternative date in accordance with the rules written here, the fee will be refunded as described above. In case of date change / date postponement, there may be differences in the Reservation Fee and other fees. These fee differences (the differences between the prices/fees determined for the first reservation and the prices/fees to be applied for the changed date) shall be borne by the Guest.
In case the reservation is postponed to a later date due to force majeure, Teknevia's liability is limited to a 24-month period and 1 postponement. In case the delay exceeds 24 months or there are two or more delays, the Guest and the Ad Owner do this among themselves. Teknevia has no obligation to make any effort to reach an agreement on such matter, and an agreement on this matter will be considered a relationship independent of the Equipment rental or Services provision relationship established through Teknevia's services. Teknevia is not responsible for the delays agreed between the Guest and the Ad Owner, without any force majeure, and Teknevia rejects its responsibility for the reservation that occurs after such a delay, to the fullest extent permitted by law.
In any case, in order for the "date change" / "date postponement" option to be used, the Guest must notify Teknevia on which dates the Equipment can be rented or Teknevia Services can be offered to them. Otherwise, the Guest cannot benefit from this right and Teknevia will not be responsible for the organization of the postponement.
AUTHORIZATION OF PAYMENT
The Announcer accepts in advance to appoint Teknevia and Teknevia's Distribution Partners as the authorized representative acting by proxy, regarding the collection transactions subject to the Distance Sales Contract and limited to these transactions only. Any action to be taken by Teknevia and/or Teknevia's authorized persons and/or Teknevia's Distribution Partners shall be deemed to have been made on their behalf before the Announcer.
In this context, together with the third party PPEs (payment service providers) making payment to the Announcer and the determination of the transfer of the relevant funds to the Announcer in the records of the third party PPEs, and/or Teknevia and/or By making this payment directly by Teknevia's Distribution Partners, the third party ÖSAs or Teknevia or Teknevia's Distribution Partners (whichever paid) will be relieved of their payment obligation, and the Ad Owner or Guest will be freed from third party ÖHSs or Teknevia. or Teknevia will not make any claims and/or claim rights from the Distribution Partners in this regard.
“Distribution Partner” / “Distribution Partners” means the relevant Equipment or Teknevia Services through their agents or other members, who are in cooperation with Teknevia and can post advertisements for the purchase or rental of the relevant Equipment or Teknevia Services within the framework of this cooperation. means any third party whose marketing is possible.
6. PROVIDER'S SOLUTIONS FOR COMPLAINTS
Any complaint of the Guest, who is a consumer, can be conveyed to the Ad Owner, who is the provider, via the contact information of the Ad Owner under article 2 above. In case of any problem regarding the contact information under Article 2 and/or if the said information is unavailable, the consumer can forward all his/her complaints to the provider through Teknevia. For this purpose, the consumer can reach Teknevia through all communication channels whose information is given under article 3.
In addition, consumers can directly convey their complaints about the services they have purchased to the Ad Owners, or they may use Teknevia's website to convey their complaints to the Ad Owners. If the consumer submits his/her complaint to Teknevia, Teknevia will provide all reasonable support to resolve the related issue.
7. RIGHT OF WITHDRAWAL
Pursuant to Article 15, paragraph 1, clause (g) of the Regulation on Distance Contracts, the consumer's withdrawal regarding "contracts for accommodation, transportation of goods, car rental, food and beverage supply and the use of leisure time for the purpose of entertainment or rest, which must be made on a certain date or period". has no right.
The service/services that are the subject of this Preliminary Information Form include renting an Equipment for entertainment purposes on a certain date or a Teknevia Services for entertainment purposes. In case the consumer approves the distance sales contract for the purchase of the services subject to this Preliminary Information Form, since it is related to the purchase of the services subject to this Preliminary Information Form, since it is related to the purchasing of There will be no right of withdrawal regarding the distance sales contract in question.
8. DISPUTE RESOLUTION
This Preliminary Information Form and Distance Sales Contract (if duly established) will be subject to Turkish Law and will be interpreted in accordance with Turkish Law. The responsibility for the services belongs to the Ad Owner, who is the provider himself.
For disputes up to the value declared by the Ministry of Commerce every year in disputes regarding this Preliminary Information Form and Distance Sales Agreement, Provincial or District Consumer Arbitration Committees in the place where the consumer transaction is made or where the consumer is located, and in case of disputes above the said value, the consumer action The Consumer Courts in the place where the consumer is located or where the consumer is located are authorized.
The Turkish version of this agreement is binding on the parties, and the English version has been prepared for information purposes. In case of conflict between the English and Turkish versions, the Turkish version will prevail and be implemented.
